PRACTICE 02 — eDISCOVERY

The story is already in the data.

A modern engagement pulls from email, Slack, Teams, mobile devices, cloud drives, and SaaS platforms. We help your team identify, preserve, collect, and review it — without breaking proportionality or budget.

WHAT WE DO

eDiscovery strategy and execution, scaled to the matter.

eDiscovery has gotten harder. The data lives in more places, the volumes are larger, and the platforms change faster than the rules around them. A documented, rigorous production now requires forensic-grade preservation, judgment about scope, and technical fluency with at least a dozen modern platforms.

LTD operates as an eDiscovery consultant for law firms, in-house teams, and businesses — not as a vendor reselling review platform seats. We provide technical input on legal hold execution, custodian interview support, collection scope, processing parameters, and review workflow design, including technology-assisted review (TAR / predictive coding). On the other side of the v., we audit opposing productions for technical completeness and document anomalies in claw-back assertions.

Carlos has authored extensive published eDiscovery training material — frameworks for legal hold execution, AI in expert work, and the technical considerations that shape modern productions. The same rigor informs every LTD engagement.

METHODOLOGY

From hold to production.

The EDRM stages, but with judgment about scope, proportionality, and which battles to fight at which stage.

STEP 01
Identification & hold
Map the data landscape. Identify custodians and sources. Issue and document legal hold. Lock down auto-deletion policies.
STEP 02
Preservation & collection
Forensically preserve from identified sources. Collection scoped to relevance, with chain of custody throughout.
STEP 03
Processing & culling
Deduplicate, index, and cull by date, custodian, and search terms. TAR / predictive coding where the volume justifies it.
STEP 04
Review & production
Privilege review workflow support. Production in the format and metadata fields agreed by the parties.
